Timeline of Controversial Board Decisions 

This page will document the Board's decisions, votes, and actions, with a focus on enforcement of our 30 day minimum short term rental policies. The Board's decisions affect the safety, security and financial well-being of the Roney community. This information is essential for unit owners to make informed choices in the upcoming June 2025 election.

Roney Palace Condo Board 

Andres Lizerralde - Board Pres.
(8th Term)

Data shows that units with high guest card counts derive inordinate benefit from the amended rules. A number of these units are also suspected of violating of the 30 day minimum rental policy. These violations persist largely because the Board's refusal - of which Andres is president - to convene a fining committee, which is required by Florida State Law to enforce penalties for those who violate property rules. Unit owners have not been informed about the lost revenue from eliminating the tiered guest card billing system, a system that did not affect 430 of 564 unit owners who use guest cards responsibly. Data indicates that Andres' single unit has requisitioned 86 guest cards in two years. Andres has withheld data since these numbers have been reported. ​​

Lynn Nunes
(2nd Term)

Lynn Nunes (and/or his family) is affiliated with seven investment properties at the Roney. He has confirmed these units are investment properties operated by a managing agent. During his tenure on the Board, his affiliated units, as evidenced by BTR license numbers, have been listed on Airbnb and Vrbo for periods of less than 30 days. Data further shows that for 2023 and 2024, his affiliated units requisitioned over 800 guest cards. Despite running for election to the Board on a platform to enforce 30 day minimum rental policy, in our opinion, no significantly meaningful enforcement measures have been adopted to deter illegal overnight rental abuse. Lynn instead has voted for the removal of financial deterrents and has yet to convene a fining committee, which is required by the Florida 718 statute to take action against unit owners who violate the rules. Lynn has withheld the release of further guest card data after his high usage was identified.

Carlos Hernandez
(Replaced Board Member that Resigned)

Carlos Hernandez has a long history at the Roney Palace having formerly been the general manager for many years. Carlos is being brought in to address the scourge of illegal overnight rentals in the building and to put policies in place that proactively enforce our 30 day minimum rental rules. Proactive measures have been non-existent under the current Board.

2025

January 2025

 

- Board refused to add a fining committee to the November agenda. Unit owners petition the Board to add the fining committee to the next meeting.

- Board refuses to acknowledge their failure to impose any consequences on those unit owners or property managers who have been proven to be in violation of renting and advertising their units for less than 30 days. 

 

March 2025

 

- Board meeting is finally held to discuss fining committee. Board agrees to convene a committee but does not take an official vote as is required.

- Board hires a new lawyer and sends a cease and desist letter with unsubstantiated complaints.

 

Board withholds guest card data despite official records request. 

May 2025

​

- Arbitration is decided. The ruling confirms that the Board has the right to charge for guest cards. Those that abuse guest cards and engage in illegal rentals have lost in their quest for free guest cards. 

 

- The arbitrator further declared that the Board did not properly inform unit owners about the decision to change the guest cards to $50 and as such the decision on Nov 2024 is deemed null and void. The tiered guest card system is thus currently still in place. 

 

- Board refuses to acknowledge or set up hearings for grievances submitted by unit owners as is required by Florida statute.

February 2025

- Daniel Kowarski resigns from the Board. Andres Lizerraldi and Lynn Nunes appoint Carlos Hernandez. Carlos was not an owner but was added to an LLC of a unit owner who was suing the association for free guest cards. 

​

- Before resigning Kowarski sends cease and desist letter complaining about this website. 

​

- Daniel Kowarski receives a Miami Code Violation for renting his unit for less than 30 days.

 

-The Roney lost access to subsidized guest chairs as a direct result of the Board's failure to enforce 30 minimum guest rental policies.

April 2025

 

- Despite pressure from unit owners, no movement has been made on the fining committee - a requirement for grievances and enforcement of 30 day minimum rentals as per our rules and regulations.

​

- Board refuses to allow electronic voting despite unit owner demand and known hardship for unit owners who live overseas or have multiple dwellings. This is perceived by many as a move to suppress unit owner participation in the election

2024

March 2024
  • In March of 2024, it was discovered that Marquis was not billing for 'guest cards' as per the Rules and Regulations. Association Counsel and Marquis agreed that the billing error should be corrected immediately.

 

  • Instead of correcting the error​

    • Lynn Nunes and Andres Lizerralde perpetuating the billing errors and losses for 6 months. 

    • And failed to properly inform Unit owners were not properly informed of the error and the losses.​

​

November 2024

  • Despite extensive discussion about a fining meeting at prior meeting (board did not record), Board refused to add fining committee to the November agenda.

  • A Board meeting was called for Thanksgiving eve to discuss reducing guest card fees to $50 where owners present unanimously contested Board's decision. Despite unanimous opposition, the Board voted to ratify their amendment to our Rules and Regulations.

  • Board ignored questions about what new enforcement measures they would be implementing to enforce Roney's 30 day minimum rental policy. 

  • No new enforcement measures were considered

December 2024

  • Unit Owners, overwhelming represented by three property management companies, initiate legal action against the Association, petitioning for free guest cards.

  • Relationships between Board members and those suing the Association are revealed.

May 2024
  • Zoom Board Meeting Discussion:

  • During a Board meeting via Zoom, Lynn Nunes reveals that the Board was allowing 20 free guest cards per month (total of 240 free guest cards per unit annually).

    • This is a direct violation of the established Rules and Regulations allowing only 20 free guest cards per unit per calendar year.

    • Failure to uphold the Rules as written accounts for the illegal overnight rental proliferation within the building unit owners are complaining about.

    • Disbanding the Community Forum: During the same meeting, the Board votes to disband the community forum, which had been in place for 12 years, in an apparent move to silence complaints regarding illegal overnight rentals.

October 2024​
  • In response to pressure from unit owners, in October of 2024, the board finally agreed to follow the tiered guest card billing system - but first, in a nod to illegal overnight rentals, the Board gave an additional 20 free cards per unit for a total 40 free guest cards per year.​

  • The Board committed to changing the rules in 2025

  • Each Board decision strategically benefitted owners who defy our 30 day minimum short term rental policy and who engage in illegal overnight rentals. The board's actions inured to the detriment of all other owners.

A Summary of the financial Losses to the Association from the Board's Decision to Amend Guest Card Rules:

  • Raw data provided by Marquis through official records requests reveals the actual financial losses suffered by the Association due to the Board’s decisions for failure to bill and collect guest card fees:

    • 2023: Loss to the Association of $1,134,500 in guest card fees.

    • 2024: Loss to the Association of $1,119,267 in guest card fees.

  • Guest Card Reset Losses: For the Period of October - December 2024 the Board decided to reset guest card amounts with massive benefit to high guest card users.

    • Failure to bill and collect an additional $525,000

    • The potential projected savings for individual Board Members with high guest card usage for this 3 month period: 

      • Lynn Nunes - $70,000 ​

      • Daniel K. - $20,000

      • Andres Lizerralde - $10,000

  • Total loss incurred to Association by Board Members alone (with a collective 10 affiliated units) for 2023/2024:

    • Failure to bill and collect $288,100.

​​

  • Projected Losses for 2025:

    • We believe the Board's decision to amend the rules results in projected losses for 2025 estimated to be, conservatively, at least $1,000,000.

  • Losses to Association from Units believed to be Engaged in Illegal Overnight Rentals:

    • 21 units (3.5%) with excessive guest card usage consistent with illegal overnight rental activity would owe the Association $500,000 if billed according to our rules and regulations.

    • Each of these units has over 70 guest cards.  

    • What actions have Marquis and the Board taken to address these violations?

  • Majority of Unit Owners Do Not Receive Any Benefit:

    • The overwhelming majority of unit owners, and those who legally rent their units, have seen their interests ignored as a result of the Board’s decisions.

​​

  • Letter to Counsel:

    • A letter sent to the Association Counsel outlined how Board members and those who engage in illegal overnight rentals have personally benefited from the decisions to change the guest card rules at the expense of the majority. Counsel's response suggested that this was a matter of opinion and the Board was entitled to have a different opinion and act as they saw fit.
